Elite Service Search LLC., Inc. d/b/a Elite Service Search is a platform that assists individuals in their efforts to find, select, rate, and provide feedback on a diverse range of contractors and service providers. Elite Service Search also provides an online service to post and search for employment opportunities. The following Terms and Conditions outline your obligations when using the Elite Service Search website, and services.

1. Introduction

1.1 Elite Service Search can be assessed at www.eliteservicesearch.com and services offered on and in connection with this site are owned and operated by Elite Service Search and can only be accessed and used by you under the Terms and Conditions described below (“Terms of Use”). These Terms and Conditions (referred to as "the Terms") govern your use of the Elite Service Search website (referred to as "the Website") and the Elite Service Search services. By accessing and using the Website and its services, you acknowledge and agree that these Terms constitute the rules and conditions of access to, use of, and supply of information from the Website.

1.2 We kindly request that you carefully review this document. Your continued use of the Website and/or services provided by Elite Service Search implies your acceptance and commitment to abide by these Terms and any changes made by Elite Service Search, its authorized officers, agents, employees, or contractors to the Terms from time to time.

2. Acceptance of Terms

2.1 By using Elite Service Search (hereinafter referred to as "the Website"), you agree to comply with and be bound by these Terms and Conditions (hereinafter referred to as "the Terms"). If you do not agree to these Terms, please refrain from using the Website.

3. Definitions

3.1 "User" refers to any person or entity accessing or using the Website.

3.2 "Contractor or Service Provider" refers to any individual or company offering services through the Website.

3.3 "Service Seeker" refers to any individual or company seeking services through the Website.

3.4 “Employers” refers to any individuals seeking employment, and/or information related to an employment or job search (“Job Seekers”)

3.5. “Employers” refers to organizations seeking to provide information and to search for individuals regarding open employment positions, including employment agencies.

4. Description of the Service

4.1 The Website provides a platform that connects Service Seekers with Contractors or Service Providers for various contracting and service-related purposes. The website also provides an online service to post and search for employment opportunities.

5. User Registration

5.1 Users may be required to register an account to access certain features of the Website.

5.2 By completing the Elite Service Search user registration process, you agree to be bound by these Terms and Conditions. A link to this Terms and Conditions Agreement will be published on the user registration forms owned and operated by Elite Service Search (website).

5.3 Users are responsible for maintaining the confidentiality of their account credentials and are liable for all activities conducted through their accounts. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be responsible for all uses of your Elite Service Search registrations and passwords, whether or not authorized by you. You agree to immediately notify Elite Service Search of any unauthorized use of your account or passwords.

6. Email Communication

6.1 From time to time the website will generate automated emails to registered users, or website users will send emails and messages to one another through the website. Emails sent by the website or through the website are considered a part of the Elite Service Search website.

6.2 Should you no longer wish to receive our emails, you may click on the unsubscribe link located in each email received or email us at contact@eliteservicesearch.com with a request to unsubscribe.

7. Outside Sites

7.1 If hyperlinks and other redirection tools taking the user to other websites operated by third parties appear on the website, you acknowledge that these websites (Outside Sites) are not controlled by Elite Service Search and do not form part of the Elite Service Search website and agree that you will not hold Elite Service Search liable or in any way accountable for anything that occurs on Outside Sites.

8. Content Published on the Website

8.1 The information, opinions, and other similar statements and content published on the website are provided for information purposes only and are not intended as, nor do they constitute legal, financial, taxation, technical, or expert advice or to be in any way relied upon by you without undertaking your independent verification. Information provided on the website has been derived from sources believed to be accurate at the time of compilation and no warranty or representation is made as to the accuracy or authenticity of the content of the website.

8.2 Elite Service Search and its directors, agents, or employees do not accept and are by these Terms and Conditions released by you of any liability to you arising (whether directly or indirectly) out of the information provided on the website or anyone else through the website or any errors in, or omissions from the information on the website.

8.3 Elite Service Search does not make any representation or warranty that any user is reputable, or will act in good faith, or according to their terms of engagement; any information on the website will be complete, reliable, or accurate; or your access to the website will be secure, available or uninterrupted.

8.4 Elite Service Search disclaims and will not be liable for loss arising out of (whether directly or indirectly) an action or decision by you in reliance on the information on or provided to you through the website or provided by any business you engage on the website, nor any interruption, delay or impairment in the functioning, operation or availability of the website, exposure to or transmission of any computer virus, internet access difficulties in connection with the website, or malfunction in equipment or software.

8.5 You should seek legal or other professional advice before acting or relying on the information set out on or provided to you through the website or provided by any business you engage on the website.

8.6 Information on the website is for general information only. As a user of the website, you should make your inquiries and obtain independent advice based on your specific circumstances before making any decisions.

9. User Responsibilities

9.1 Users agree to provide accurate and truthful information when using the Website.

9.2 Users must not engage in any fraudulent, misleading, or malicious activities on the Website such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses, or pirating media.

9.3 Users must not post any resume or Profile or apply for any job on behalf of another party; defer any contact from an employer to any agent, agency, or other third party; set more than one copy of the same resume to public at any one time; share with a third party any login credentials to any Elite Service Search site; access data not intended for you or logging into a server or account which you are not authorized to access; post or submit to any Elite Service Search site any incomplete, false or inaccurate biographical information or information which is not your own; post content that contains restricted or password-only access pages, or hidden pages or images; solicit passwords or personally identifiable information from other Users; delete or alter any material posted by any other person or entity; harass, incite harassment or advocate harassment of any group, company, or individual; send unsolicited mail or email, make unsolicited phone calls or send unsolicited texts, tweets or faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by you; attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any Elite Service Search Site, overloading, "flooding", "spamming", "mailbombing" or "crashing"; promote or endorse an illegal or unauthorized copy of another person's copyrighted work, such by as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files; or use the Elite Service Search Services for any unlawful purpose or any illegal activity, or post or submit any content, resume, or job ad that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by Elite Service Search’s discretion.

9.4 Users who violate these Terms may have their access and use of the Elite Service Search Sites suspended or terminated, at Elite Service Search’s discretion. Violations of system or network security may result in civil and/or criminal liability. Elite Service Search will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

9.5 Employers are solely responsible for their postings on Elite Service Search Sites. Elite Service Search is not to be considered to be an employer concerning your use of any Service Search Site and Elte Service Search shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any Elite Service Search Site.

9.6 You understand and acknowledge that if you cancel your employer account or your employer account is terminated, all your account information from Elite Service Search, including saved resumes, network contacts, and email mailing lists, may be deleted from Elite Service Search's databases. Information may continue to be available for some time because of delays in propagating such deletion through Elite Service Search’s web servers. You shall use Elite Service Search profiles by all applicable privacy and data protection laws.

9.7 Users agree not to misuse the Website by violating any applicable laws, regulations, or these Terms.

9.8 Your Conduct: As a condition of your use of the website or any service provided by Elite Service Search, you warrant to Elite Service Search that you will not use the website of any Elite Service Search service for any purpose that is prohibited by the Terms and Conditions or that is illegal or unlawful. You agree to abide by all applicable laws and regulations.

Whilst not an exhaustive list, you agree not to:

use the website to offend others (which shall be judged in the absolute opinion of Elite Service Search);

publish, or in any way distribute or disseminate any information that is unlawful, obscene, defamatory, offensive, or inappropriate (which shall be judged in the absolute opinion of Elite Service Search);

engage in, encourage participation, or promote any contests, pyramid schemes, surveys, chain letters, spamming, or unsolicited emailing through the website;

use automated scripting tools or software;

make available, using the website, any material you do not have a right to make available including any law or which contains viruses, or other computer codes, files, or programs designed to interfere with the functioning of other software or hardware; or breach any laws or regulations applicable to your use of the website;

use the site to supply another service, or to obtain information that you either incorporate into your service or product to enhance your service or product or your business in any way such as creating potential customer lists. Any commercial use of the website requires the prior written approval of Elite Service Search.

Elite Service Search has no obligation to monitor your or anyone else’s use of the website. However, Elite Service Search reserves the right at all times to monitor, retain, and disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request.

9.9 Objectionable content: You may not post nude, partially nude, pornographic, sexually suggestive photos, violent, discriminatory, hateful, unlawful, or infringing content via the website or Apps.

You must not stalk, bully, abuse, threaten, harass, defame, impersonate, or intimidate people or entities and you must not post private or confidential information via the website and Apps, including, without limitation, your or any other person’s credit card information, non-public phone numbers or non-public email addresses.

10. Contractors or Service Providers and Service Seekers

10.1 Contractors or Service Providers agree to provide accurate information about their services, qualifications, and pricing.

10.2 Service Seekers agree to provide accurate information about their service needs and expectations.

11. Elite Service Search Job Posting

11.1 Each Job Seeker acknowledges that job posts are created by third parties over whom Elite Service Search has no control, and Elite Service Search has no control over the content of job posts or links from job posts.

11.2 A job post may not contain any hyperlinks, other than those specifically authorized by Elite Service Search; misleading, unreadable, or "hidden" keywords, repeated keywords, or keywords that are irrelevant to the job opportunity being presented, as determined in Elite Service Search’s reasonable discretion; the names, logos or trademarks of unaffiliated companies other than those of your customer; the names of colleges, cities, states, towns or countries that are unrelated to the posting; more than one job or job description; inaccurate, false, or misleading information; and material or links to material that exploits people in a sexual, violent or another manner, or solicits personal information from anyone under 18.

11.3 You may not use Your Elite Service Search Job Post to: post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property; post jobs that require citizenship of any particular country or lawful permanent residence in a country or possession of a certain type of visa, unless otherwise required in order to comply with laws, regulations, executive orders, or a federal, state or local government contract; post jobs that include any screening requirement or criterion in connection with a job post where such requirement or criterion is not an actual requirement of the posted job; with respect to profiles, determine a consumer's eligibility for: credit or insurance for person, family, or household purposes; employment; or a government license of benefit; promote or advertise career fairs, job fairs, hiring events, conferences, seminars or open houses or any other event or meeting without Elite service Search’s prior approval; post jobs or other advertisements for competitors of Elite Service Search or post jobs or other content that contains links (other than links to apply for the job) to any site competitive with Elite Service Search; sell, promote or advertise products or services; post any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative agency arrangement; post any business opportunity that requires an up-front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents; post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling; promote any opportunity that does not represent bona fide employment which is generally indicated by the employer’s use of IRS forms W-2 or 1099; post jobs on any Elite Service Search Site for modeling, acting, or entertainment agencies or modeling or acting scouting positions; advertise sexual services or seek employees for jobs of a sexual nature; request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy; endorse a political party, political agenda, political position or issue; promote a religion; post jobs located in countries subject to economic sanctions of the United States Government; and except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her racial or ethnic origin, political beliefs, philosophical or religious beliefs, membership of a trade union, physical or mental health (including pregnancy status), sexual life, the commission of criminal offenses or proceedings, age or sex or gender.

11.4 Elite Service Search reserves the right to remove any job post or content from any Elite Service Search Site, which in the reasonable exercise of Elite Service Search’s discretion, does not comply with the above Terms, or if any content is posted that Elite Service Search believes is not in the best interest of Elite Service Search.

11.5 If at any time during your use of the Elite Service Search Services, You made a misrepresentation of fact to Elite Service Search or otherwise misled Elite Service Search in regards to the nature of your business activities, Elite Service Search will have grounds to terminate your use of the Elite Service Search Services.

12. Elite Service Search Resume Database

12.1 Employers shall use the Resume Database as provided in these Terms. you shall use the Resume Database by all applicable privacy and data protection laws, and you agree you shall not further disclose any of the data from the Resume Database to any third party unless you are an authorized recruitment agency, staffing agency, advertising or other agency or using the resume explicitly for employment purposes.

12.2 You may not use the Resume Database in any way which, in Elite Service Search’s sole discretion, adversely affects Elite Service Search’s business, business prospects, the performance or function of any Site or the Resume Database, or interferes with the ability of other subscribers to access the Resume Database.

12.3 You shall take appropriate physical, technical, and administrative measures to protect the data and Information you have obtained from the Resume Database from loss, misuse, unauthorized access, disclosure, alteration, or destruction. You shall not share Resume Database seat-based license login credentials with any other party, nor share Resume Database pay-per-view license login credentials with any party.

12.4 The Resume Database and information obtained from the Resume Database shall not be used:

(a) for any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any resume holders;

(b) to send emails or text messages or make phone calls to resume holders that, in Elite Service Search’s sole discretion, are excessive in frequency or related to job pots that are irrelevant to the work history or location of, or unlikely to be of interest to, the resume holder contacted;

(c) to make unsolicited phone calls or faxes or send unsolicited mail, email, texts, or newsletters to resume holders or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has not informed you that they do not want to be contacted); or

(d) to source candidates or to contact job seekers or resume holders in regards to career fairs and business opportunities prohibited by these Terms; or

(e) take any other action that is, in Elite Service Search’s sole discretion, inconsistent with these Terms, misleading or incomplete, or in violation of any federal, state, or local law, statute, code, rule, or regulation.

To ensure a safe and effective experience for all of our customers, Elite Service Search reserves the right to limit the amount of data (including resume views) that may be accessed in the Resume Database by You or the number of contacts, emails, or messages You may make or send within any Elite Service Search system in any given period. These limits may be amended at Elite Service Search’s sole discretion from time to time.

13. Additional terms applicable to Job Seekers

13.1. You acknowledge and agree that you are solely responsible for the form, content, and accuracy of any resume or Information contained therein placed by you on the Elite Service Sites.

13.2 You acknowledge and agree that you should protect your personal information by never providing social security, credit card, or bank account numbers to prospective employers.

13.3 Elite Service Search reserves the right to offer third-party services and products to you based on the preferences that you identify in your registration and at any time thereafter or you have agreed to receive, such offers may be made by Elite Service Search or by third parties. Please see Elite Service Search's Privacy Policy, for further details regarding your Information.

13.4 You understand and acknowledge that you have no ownership rights in your account and that if you cancel your Elite Service Search account or Your Elite Service Search account is terminated, all your account information from Elite Service Search, including resumes, profiles, cover letters, saved jobs, questionnaires will be marked as deleted in and may be deleted from Elite Service Search's databases and will be removed from any public area of the Elite Service Search Sites. Information may continue to be available for some time because of delays in propagating such deletion through Elite Service Search’s web servers. In addition, third parties may retain saved copies of your Information.

13.5 Elite Service Search reserves the right to delete your account and all of your Information after a significant duration of inactivity.

14. User Content and Submissions

14.1 You understand that all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages, or other materials submitted, posted, or displayed by you on or through an Elite Service Search Site ("User Content") is the sole responsibility of the person from which such User Content originated. Elite Service Search claims no ownership or control over any User Content. You or a third party licensor, as appropriate, retain all patent, trademark, and copyright to any User Content you submit, post, or display on or through Elite Service Search and you are responsible for protecting those rights, as appropriate. By submitting, posting, or displaying User Content on or through Elite Service Search, you grant Elite Service Search a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, adapt, distribute, and publish such User Content through Elite Service Search. In addition, by submitting, posting, or displaying User Content that is intended to be available to the general public, you grant Elite Service Search a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute, and publish such User Content to promote Elite Service search and its services. Elite Service Search will discontinue this licensed use within a commercially reasonable period after such User Content is removed from Elite Service Search. Elite Service Search reserves the right to refuse to accept, post, display, or transmit any User Content in its sole discretion.

14.2 You also represent and warrant that you have the right to grant, or that the holder of any rights, including moral rights in such content has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant, the license stated above. If you post User Content in any public area of any Elite Service Search Site, You also permit any User to access, display, view, copy, and store such User Content for personal use. Subject to the foregoing, the owner of such User Content placed on any Elite Service Search Site retains any rights that may exist in such User Content. Elite Service Search may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules, or regulations, is abusive, disruptive, offensive, or illegal, or violates the rights of, or harms or threatens the safety of, Users of any Elite Service Search Site. Elite Service Search reserves the right to expel Users and prevent their further access to the Elite Service Search Sites and/or use of Elite Service Search Services for violating the Terms or applicable laws, rules, or regulations. Elite Service Search may take any action concerning User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for Elite Service Search, damage Elite Service Search’s brand or public image, or cause Elite Service Search to lose Users or (in whole or in part) the services of its ISPs or other suppliers.

14.3 Elite Service Search does not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by Users nor does Elite Service Search endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at Your own risk.

14.4 The following is a partial list of User Content that is prohibited on the Elite Service Search Sites. The list below is for illustration only and is not a complete list of all prohibited User Content.

Content that:

is implicitly or explicitly offensive, such as User Content that engages in, endorses, or promotes racism, bigotry, discrimination, hatred, or physical harm of any kind against any group or individual;

harasses, incites harassment, or advocates harassment of any group or individual;

involves the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing, “spamming” or “phishing”;

promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

contains restricted or password-only access pages, or hidden pages or images;

displays or links to pornographic, indecent, or sexually explicit material of any kind;

provides or links to material that exploits people under the age of 18 in a sexual, violent, or other manner, or solicits personal information from anyone under 18; or

provides instructional information about illegal activities or other activities prohibited by these Terms, including without limitation, making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses, or pirating any media; and

solicits passwords or personally identifying information from other Users.

Any Profile You submit must describe You, as a person. Examples of inappropriate and prohibited Profiles include, but are not limited to, Profiles that purport to represent an animal, place, inanimate object, fictional character, or real individual that is not You.

14.5 Profiles derived from User Content may also be made available through the Elite Service Search Sites. Elite Service Search does not make any representations regarding the accuracy or validity of such derived works or their appropriateness for evaluation by employers. Derived Profiles may differ significantly from User Content.

14.6 We appreciate hearing from our Users and welcome Your comments regarding our services and the Elite Service Search Sites. Please be advised, however, that our policy does not permit us to accept or consider creative ideas, suggestions, inventions, or materials other than those which we have specifically requested. While we do value Your feedback on our services, please be specific in Your comments regarding our services and do not submit creative ideas, inventions, suggestions, or materials. If, despite our request, You send us creative suggestions, ideas, drawings, concepts, inventions, or other information (collectively the "Submission"), the Submission shall be the property of Elite Service Search. None of the Submission shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any Submission. Elite Service Search shall own exclusively all now-known or later discovered rights to the Submission and shall be entitled to unrestricted use of the Submission for any purpose whatsoever, commercial or otherwise, without compensation to You or any other person.

15. Service Intermediary

15.1 Elite Service Search is an intermediary and is not directly involved in the actual transactions between business users and customers who contract their services after initial introduction via the website. We do not assume responsibility for the quality, safety, or legality of the items or content posted by any user, the accuracy of postings, the capacity of businesses to provide services, or the ability of customers to purchase services. We cannot guarantee or ensure that a customer or business user will complete a transaction or act lawfully while using the website.

16. Background Checks

16.1 Elite Service Search performs certain background checks on business members using third-party identity verification services, including the Document Verification Service (DVS) and the Secretary of State. While these checks can be passed using falsified documentation and are not entirely reliable, Elite Service Search cannot confirm the actual identity of each business user. We strongly recommend conducting background checks on any businesses before engaging them for services.

16.2 We require business users of the website to complete the required steps of the Background Check before they can contact customers. This includes passing an identity check using a 3rd party verification service.

17. Email Notices

17.1 Elite Service Search sends emails and notices regarding the status of your transactions and user account. These emails and notices do not constitute a guarantee or endorsement of your transactions. You are responsible for completing all transactions in which you participate, including monitoring the status of these transactions and complying with all relevant legal and other obligations. Elite Service Search does not control, endorse, or approve the services provided by users of the website.

18. Dealing with Underage Persons or Fraud

18.1 You acknowledge and release Elite Service Search if you engage with underage persons or individuals acting under pretenses.

19. Warranty

19.1 You agree to assume sole responsibility for the legality of your actions according to the applicable laws. Elite Service Search bears no responsibility for the legality of the actions of website users or Elite Service Search services.

20. Indemnity

20.1 You indemnify and release Elite Service Search, its directors, employees, agents, contractors, and affiliates from any claims, demands, proceedings, losses, and damages of every kind and nature, including reasonable solicitor’s fees, made by you or any third party due to or arising, whether directly or indirectly, from your breach of these Terms and Conditions or your violation of any law or the rights of a third party.

21. No Agency

21.1 You and Elite Service Search are independent contractors. No agency, partnership, joint venture, employee-employer, or franchisee-franchisor relationship is created or intended by this Terms and Conditions agreement or your use of the website or Elite Service Search services.

22. User Information

22.1 As a user of the website, you must provide Elite Service Search with complete, up-to-date, and accurate information as requested. It is your responsibility to inform Elite Service Search of any changes to that information. All personal information you provide as a user will be handled by the Personal Information & Privacy Policy outlined below. Elite Service Search reserves the right to modify or delete any general information submitted to the website to enhance the services provided to you and other Elite Service Search users.

23. Username & Password

23.1 To become a member of Elite Service Search, you will select a username and password. Your username must be a valid email address belonging to you. You are responsible for all activities under your username and password and must keep these credentials confidential. If you become aware of any unauthorized use of your username and password, please notify Service Seeking immediately by email at contact@eliteservicesearch.com Each username and password is intended for use by a single individual and is not transferable.

24. Phone Recordings

24.1 Elite Service Search reserves the right to record phone calls between you and Elite Service Search employees or agents for training purposes.

25. Dispute Resolution

25.1 Elite Service Search will use reasonable endeavors to mediate any dispute concerning the use by parties of the website.

25.2 Disputes about the actual services carried out by a business or any other issue will be referred, where appropriate, to external dispute resolution services or authorities.

25.3 Users are encouraged to resolve any disputes between Contractors or Service Providers and Service Seekers amicably. The Website does not assume responsibility for resolving disputes.

27. Consumer Reviews Policy

27.1 Elite Service Search allows users of the Elite Service Search website (Consumers) to rate and comment on the performance of Elite Service Search business users (Businesses) whose business services they have contracted and directly experienced through the Elite Service Search website.

27.2 Consumers can leave a public review and submit a star rating about a Business. The Business can make a protest for wrongful or fake reviews.

27.3 Any ratings or reviews reflect the opinion of Consumers who have experienced the product or service and do not reflect the opinion of Elite Service Search.

27.4 By using the Elite Service Search website, Consumers and Businesses:

(a) warrant to Elite Service Search (to the best of their knowledge and belief) the accuracy or truthfulness of any review and/or reply;

for any false or misleading reviews or replies to be posted; and

(b) agree to hold Elite Service Search harmless for any losses (however incurred) caused by their conduct.

27.5 Elite Service Search does not moderate reviews or replies. However, in certain limited situations, Elite Service Search reserves the right to remove any reviews and/or replies which:

(a) breach our terms and conditions;

(b) breach this policy (or any other Elite Service Search policies);

(d) have not been written (or expressly authorized) by Consumers who have directly received a service or product through the Elite Service Search website;

(e) are misleading or deceptive and otherwise contravene the Federal Trade Commission or similar laws;

(f) are offensive or defamatory; and/or

(g) have been written in exchange for, or on the promise of, payment, additional services, or discounted rates.

28. Testimonials from consumers outside of Elite Service Search

28.1 Businesses can request, through the Elite Service Search website, that any past consumer (Past Consumer) who has previously retained their services outside of Elite Service Search provide a testimonial of the service or product received by the Past Consumer. The testimonials will not be used in any Elite Service Search ratings.

28.2 By using the testimonial feature, the Business:

(a) warrants to Elite Service Search that it has provided the Past Consumer with the service or product that is the subject of the testimonial;

(b) acknowledges that it is a contravention of the Federal Trade Commission and this policy for any false or misleading testimonial to be posted; and

28.3 By using the testimonial feature, the Past Consumer:

(a) warrants to Elite Service Search that it has directly received the service or product from the Business that is the subject of the testimonial;

(b) acknowledges that it is a contravention of the Federal Trade Commission and this policy for any false or misleading testimonial to be posted; and

28.4 Elite Service Search does not moderate testimonials. However, in certain limited situations, Elite Service Search reserves the right to remove any testimonials which:

(a) breaches our terms and conditions;

(b) breaches this policy (or any other Elite Service Search policies);

(d) have not been written (or expressly authorized) by the Past Consumer who has directly received the service or product that is the subject of the testimonial;

(e) are misleading or deceptive and otherwise contravene the Federal Trade Commission or similar laws;

(g) have been written in exchange for, or on the promise of, payment, additional services, or discounted rates.

29. Negative Reviews & Feedback

29.1 Save for the limited exceptions set out in this policy, any negative reviews, testimonials or Fast Feedback left by Consumers or a Past Consumer will be displayed on the Business’ Elite Service Search profile.

29.2 Businesses will be able to respond to any feedback. Businesses are allowed only one response per feedback. Businesses’ replies will be publicly visible underneath the original Consumer feedback or Past Consumer testimonials.

29.3 Elite Service Search will only remove disputed feedback or comments if both Consumers and Businesses have expressly agreed to do so. Where both Consumers and Businesses agree, Elite Service Search will use reasonable endeavors to mediate any dispute concerning any negative feedback.

30. Reporting Suspected Breaches of our Consumer Reviews Policy

30.1 Consumers and Businesses can report any suspected breaches of this policy by emailing us at contact@eliteservicesearch.com

31. Consequences of Non-Payment

31.1 If you do not pay monies owed by the date the payment is due we will notify you and request immediate payment. If you fail to pay the overdue amount within a reasonable time as set out in the notice, we may:

31.2 Suspend, cancel, or limit your access to the website; If the Service is canceled due to non-payment the default leading to the cancellation may be disclosed to a credit reporting agency, or collection agency and may be added to your credit file with a credit reporting agency;

Engage a debt collection agent to recover the money you owe us or institute legal proceedings against you to recover the money you owe us. You must reimburse us any reasonable costs that we incur in pursuing payment of amounts you owe us; and

On-sell any unpaid amounts to a third party. If we do this, any outstanding amounts will be payable to that third party. We will notify you within 25 business days that any unpaid amounts you owe us have been sold to a third party (or arrange for the purchaser to notify you of this).

32. Breaching Our Terms and Conditions

32.1 Without limiting other remedies available to Elite Service Search at law, in equity, or under this Terms and Conditions, we may, in our sole discretion, immediately issue a warning, temporarily suspend or terminate your membership, and refuse to provide services to you if:

you breach these Terms and Conditions or Personal Information & Privacy policy;

we are unable to verify or authenticate any information you provide to us; or

We believe your actions may cause legal liability to you, Elite Service Search users, or Elite Service Search.

33. Termination

33.1 The Website reserves the right to terminate or suspend user accounts and access to the Website for violations of these Terms or any other reason, without notice.

33.2 If this happens we may notify you by email. If your use of the website is terminated: you are no longer authorized to access the website or use any other Elite Service Search services with the email address you used to register with the site or any other email address you possess; you will continue to be subject to and bound by all restrictions imposed on you by the Terms and Conditions; and all licenses granted by you and all disclaimers by Service Seeking and limitations of Service Seeking’s liability set out in the Terms and Conditions or elsewhere on the website will survive.

33.3 If you object to any of the Terms and Conditions or any subsequent changes to them, or if you become dissatisfied with your use of the Elite Service Search services in any way, your sole remedy is to immediately discontinue your use of the services of Service Seeking and exit the Website.

We reserve the right not to respond to customer inquiries that offend our employees or agents.

We reserve the right not to respond to inquiries made by individuals who, in our opinion, are not current users of the website, or have been suspended from using the website.

35. Consumer Complaints

35.2 All complaints will be handled according to the following process:

We will confirm the receipt of complaints by reply email within 1 business day of the first contact made by email to contact@eliteservicesearch.com

Following appropriate investigation and consideration we will provide a final response to you, within 30 calendar days, detailing any proposed action;

If you are not happy with our response or how the complaint has been handled, you may be able to raise a complaint with your local state or territory consumer protection agency or the Federal Trade Commission.

36. Suspension and Termination of Business User Accounts

36.1 Business users of the website may have their access to the website and Elite Service Search services suspended for any length of time for any breach of the Terms and Conditions, as well as, but not limited to, any of the following reasons:

providing false or inaccurate information during business registration or when quoting on the website;

providing false or inaccurate information to Elite Service Search employees or agents;

receiving in aggregate more than 2 negative feedback ratings or complaints from other website users in relation to services contracted by the users who initiate the negative feedback or complaint (2 strikes and you’re out policy);

acting as an agent of another business or individual who is not a current paying business member of the website without the written approval of Elite Service Search; and,

submitting quotes via any means to any other person or entity for work that the business user is not qualified, or licensed to perform.

37. Cancellations of Paid Business Memberships

37.1 Users of the website that pay for membership (paying businesses) are entitled to contact, and offer quotes to, other website users who have submitted a job listing on the website matching the paying business’ industry and geographic settings.

Paying businesses can cancel future payments for their membership at any time by visiting eliteservicesearch.com while logged in to their account.

Paying businesses must click Cancel and select a reason for canceling their Membership. They will be able to access all the features of their Membership up until the expiry date shown on eliteservicesearch.com

If a paying business attempts to cancel online but cannot complete the cancellation, they may contact support at email contact@eliteservicesearch.com. and clearly state they wish to cancel their membership. This email must be received by the support team at least 2 business days before the next billing date indicated on the paying business account. Communication received closer to the next billing date will be processed after the next billing date shown on the account.

Paying businesses that have prepaid for any length of time will not be refunded for the unused portion of their membership by the Refunds Policy.

38. Refunds Policy (Business)

38.1 Paying businesses can access the quoting and messaging facilities on the website. Subject to the Federal Trade Commission, Paying businesses agree that all products/services are non-refundable at the time that payment is made.

38.2 If you are dissatisfied with the website or Elite Service Search services you are free to discontinue using the website, and as such membership fees or other payments you have made to Elite Service Search are not subject to refunds.

38.3 In the case of an event not specifically covered in the Refund Policy, refunds will be given at the discretion of Elite Service Search.

38.4 Refunds paid by this Refund policy will be paid within 60 business days via the same method the payment to be refunded was made to Elite Service Search in the first instance.

38.5 Business users who claim a refund from their credit card provider or bank without contacting our Customer Support team first (unauthorized refund) will have their paid membership immediately suspended. Elite Service Search may issue an invoice to recover up to the full value of any unauthorized refund to the relevant business user. Elite Service Search may contract a debt collection agency or use other legal means to recover unauthorized refunds. Elite Service Search may charge you interest plus any costs we incur as a result of collecting your payment.

39. Updates to the Website

39.1 Elite Service Search may from time to time and at any time change or discontinue any feature of the website including content, hours or availability, and equipment required for access.

40. Arbitration

40.1 Any controversy or claim arising out of or in connection with these Terms and Conditions may at our discretion be settled by binding arbitration through a commercial dispute resolution center selected by us. You agree to be bound by the ruling arbitrator. The costs of the dispute are borne by the originator of the dispute.

2. Elite Cash Back Calculation and Disbursement

2.1 Cash back rewards are calculated based on a percentage of the total invoice amount submitted through the EliteServiceSearch platform.

2.2 The invoice submitted by the customer through the EliteServiceSearch platform must be from completed projects or services received by Elite Contractors or Service Providers.

2.3 The annual cash back amount that a customer can receive is capped as specified on the EliteServiceSearch website.

3. Withdrawal Minimum

3.1 Customers may only withdraw their accumulated cash back rewards once they reach a minimum threshold, which is also specified on the EliteServiceSearch website.

3.2 Customers must link their bank account information in order to withdraw their accumulated cash back rewards once they reach a minimum threshold.

3.3 EliteServiceSearch reserves the right to adjust this minimum threshold at any time.

4. Responsibility and Liability

4.1 EliteServiceSearch is not responsible for any errors, mishaps, or discrepancies related to invoices submitted by customers.

4.2 EliteServiceSearch is not liable for any financial losses incurred due to typographical errors or inaccuracies in invoice submissions.
